Surveyall.com is obligated to post the change of the Terms of Use on our site. Unless otherwise specified, such changes shall be effective when they are posted on the Surveyall.com website. In addition, when using particular Site services, Users are expected to follow any posted guidelines or rules. Users are responsible for providing accurate, timely and required information to us in connection with their registration for and use of the Site. Surveyall.com is not responsible for any claims relating to any inaccurate, untimely or incomplete information provided to us.
Information Collection
All rights of all information collected using our service through the use of the Site belongs solely to you. This information will not be passed to another company or person. E-mail addresses that are collected in response to your surveys will never be used for marketing, sales or any other reason.
Description of Service
Surveyall.com currently provides users with access to a on-line questionnaire system (the "Service"). Unless explicitly stated otherwise, any enhancement or augmentation of the current Service, will subject to the TOS. You understand and agree that the Service is provided "AS-IS" and that Surveyall.com assumes no responsibility for the mis-delivery, timeliness, deletion and failure to store any user data, information, communications or personalization settings.
User Conduct
Unauthorized individuals attempting to access the service areas in the Site may be subject to prosecution. A member is required to create a Login ID and Password and each member is responsible for keeping this information secret. Members may change their Password at any time. Surveyall.com is not liable for any loss or damage resulting from a failure to maintain the confidentiality of one's password information. Users shall use Surveyall.com for lawful purposes only. Users shall not post or transmit through Surveyall.com any material which violates or infringes in any way upon the rights of others, which is unlawful, threatening, abusive, defamatory, invasive of privacy or publicity rights, vulgar, obscene, profane or otherwise objectionable, which encourages conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any law, or which, without Surveyall.com's express prior approval, contains advertising or any solicitation with respect to products or services. Any conduct by a User that in Surveyall.com's discretion restricts or inhibits any other User from using or enjoying Surveyall.com will not be permitted. Users shall not use Surveyall.com to advertise or perform any commercial solicitation, including, but not limited to, the solicitation of users of Surveyall.com.com to become users of other on-line services competitive with Surveyall.com.com. Failure to abide by the Terms of Use may result in the suspension or termination of their access to the Site, at Surveyall.com's sole discretion, in addition to any other remedies set forth herein or otherwise applicable in law or equity. You acknowledge and agree that Surveyall.com may preserve Content and may also disclose Content if required by authorized person or in the good faith belief that such preservation or disclosure is reasonably necessary to comply with legal process, enforce the Terms of Uses, respond to claims that any Content violates the rights of third-parties or protect the rights, property, or personal safety of Surveyall.com, its users and the public.
Public Content
Many areas of the Site are public and not private communications. Surveyall.com does not endorse chat, postings, conferences and other communications by Users, and such communications shall not be considered reviewed, screened or approved by Surveyall.com. A member is all responsible for any content posted and uploaded by a member through the use of the Site. Users shall retain, however, whatever other rights they have in pre-owned elements of such content. Users acknowledge that any information they post in publicly accessible areas such as Public Polls and Comments can be seen and used by the public. It is Users' responsibility to protect themselves while on Surveyall.com, as Surveyall.com is not liable for anything that occurs as a result of voluntary communication of personal information. Moderation and Termination Surveyall.com reserves the right, but is not obligated, to moderate content available through Surveyall.com. Authorized Surveyall.com staff can remove content and accounts, without notice, that they feel, in their sole discretion, violate Surveyall.com's Terms of Uses or the rules posted for individual services. Surveyall.com also reserves the right to remove content, fully access and/or close accounts to: (a) comply with legal process; (b) protect the rights, property or personal safety of Surveyall.com, our Users or the public; (c) respond to claims that any content violates the rights of third parties. Users acknowledge and agree that Surveyall.com may suspend or terminate their access or use of the Site without prior notice if they engage in conduct that Surveyall.com, in its sole discretion, believes violates any term or provision of these Terms of Use, otherwise violates the rights of Surveyall.com or third parties, or is otherwise inappropriate for continued access and use of the Site. Users further acknowledge and agree that Surveyall.com may suspend or terminate their access and use of the Site at any time, with or without cause, in Surveyall.com absolute discretion and without notice. The relevant version of these Terms of Use shall apply to all prior use of the Site. The following paragraphs of these Terms of Uses shall survive termination of a user's use or access to the Site: Paragraphs concerning Indemnification, Disclaimer of Warranties, Limitations of Liability applicable law and dispute resolution and any other provision that, by its terms, survives termination of a User's use or access to the Site.

BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A
PARTICULAR PURPOSE AND NON-INFRINGEMENT.
b. SURVEYALL.COM MAKES NO WARRANTY THAT (i) THE SERVICE WILL MEET YOUR REQUIREMENTS,
(ii) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (iii)
THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE
OR RELIABLE, (iv) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER
MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS,
AND (V) ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED.
c. ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE
IS DONE AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE
FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE
DOWNLOAD OF ANY SUCH MATERIAL.
d. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM SURVEYALL.COM
OR THROUGH OR FROM THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED
IN THE TOS.
LIMITATION OF LIABILITY
YOU EXPRESSLY UNDERSTAND AND AGREE THAT MY3Q.COM SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF SURVEYALL.COM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE SERVICE; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICE; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; OR (v) ANY OTHER MATTER RELATING TO THE SERVICE.
EXCLUSIONS AND LIMITATIONS
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS OF SECTIONS 16 AND 17 MAY NOT APPLY TO YOU.
